PLEASE READ THIS TERMS OF USE (the “TOU” or “Agreement”) CAREFULLY BEFORE USING THE HCG INC. WEBSITE OR SHOPPING CART (the “Site”) OR ANY SERVICE PROVIDED THEREIN (“Service”). This TOU is between you (“You”, “Your”, and “Yours”) and Harbinger Consulting Group, Inc. (“HCG”).
By using this Site or any Service of HCG, you signify your agreement to these terms of use. If you do not agree to these Terms of Use, do not use this Site or Service. HCG may modify these TOU at anytime and such changes will be effective on the date that such modified TOU is posted on this Site. Use of the Site or Services after such changes have taken effect constitutes acceptance of all changes.
Changes: We reserve the right to change, modify, substitute or remove without notice any information on this site from time to time. Prices, goods and availability of goods are subject to change at any time.
Communication: When you visit Harbinger-Group.com, or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Confidentiality: If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. HCG reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
Product Orders and Shipment: Laws regarding the sale of certain items may vary from state to state. It is solely the responsibility of the purchaser to be aware of and to conform to your local and state laws. Once you place an order, the payment obligation is non-cancelable and the sum paid is nonrefundable. If you have questions with your shipment, or if you believe that the contents of your order were damaged during shipping or are defective, please call your HCG representative.
Fees, Taxes and Invoices: All fees payable to HCG are due per the terms stated in your order. You will be charged using the current pricing in affect at the time of your confirmed order placement. For HCG University products, you are charged or invoiced when the products are shipped or distributed electronically. For HCG University Instructor-Led Training and Live Virtual events you will be charged or invoiced after class attendance. Standard long distance telephone rates may apply for Live Virtual/Distance Learning audio conference.
Class Cancellation/Rescheduling Policy: HCG may cancel or reschedule a class at its discretion, and if it does, will use reasonable efforts to notify you at least one week in advance. You will not be charged for the HCG cancellation or rescheduling. Please notify us as soon as possible of any changes in your scheduled training. You must call your HCG representative to cancel or reschedule a class.
Publicly Scheduled Instructor Led Training including Virtual Classes
- If you cancel or reschedule your registration 7 or more calendar days before the scheduled start date of the class: No Charge
- If you cancel or reschedule your registration 3-6 calendar days prior to the class start date: 50% of class fees due
- If you cancel or reschedule your registration 1-2 calendar days prior to the class start date: 100% of class fees due. 50% will be applied as a cancellation/reschedule fee, with the remaining 50% applied as a prepayment credit towards a future class. This credit must be used within six months of the original class start date.
- If you do not show up for the class, or you cancel on the day of the class: 100% of class fees due
Privately Scheduled Instructor Led Training including Onsite, HostSite, Mentoring, and Workshop Classes
- If you cancel or reschedule your registration 15 or more calendar days before the scheduled start date of the class: Any non-refundable travel expenses incurred will be billed
- If you cancel or reschedule your registration 6-14 calendar days prior to the class start date: 50% of total class fees due plus any non-refundable travel expenses incurred
- If you cancel or reschedule your registration the day of class, or 1-5 calendar days prior to the class start date: 100% of class fees due plus any non-refundable travel expenses incurred
Equipment and Software: Private training events, including Onsite, HostSite, Mentoring, Workshops, and any event that does not use HCG classrooms which includes Live Virtual training, you are responsible to be sure you have the proper equipment configured with necessary software prior to class. Technical setup instructions are available following registration. It is your responsibility to verify the proper setup of your training workstation. In the event you are not able to attend a class due to a failure to setup your workstation properly, the standard cancellation policy will still apply.
Limitation of Liability: This site is provided by HCG on an "as is" and "as available" basis. HCG makes no representations or warranties of any kind, express or implied, as to the operation of this site. You expressly agree that your use of this site is at your sole risk. HCG does not warrant that this site, its servers, or e-mail sent from HCG are free of viruses or other harmful components. NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE. HCG’S MAXIMUM LIABILITY FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR ORDER, WHETHER IN CONTRACT OR TORT, OR OTHERWISE, SHALL BE LIMITED TO THE TOTAL FEES PAID UNDER YOUR ORDER.
The compilation of all content on this site is the exclusive property of The Harbinger Consulting Group (HCG) and protected by U.S. and international copyright laws. HCG grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of HCG.
By visiting this site, you agree that the laws of the state of Minnesota, without regard to principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute of any sort that might arise between you and HCG. |
